I look forward to speaking with you soon. *****NEWS UPDATE****** The New Fine Gael & Labour led Government have indicated it is their intention to implement a tenant deposit protection scheme during the lifetime of the next Dail. Details are sketchy at present but it would appear the most likely model will be one which is similar to that which operates in the UK.In the UK landlords are obliged to use one of two systems a) an insurance based scheme and b) landlord holds the deposit but must register it with regulator. In the case of the former the landlord hands the deposit over to an insured and bonded firm which 'guards' the deposit for the duration of the tenancy. At the end of the tenancy if there is no dispute the deposit is returned. If however a dispute does arise an adjudicator is called in to determine damages or rewards due in connection with the issues that may arise at the end of a tenancy. In the latter case the landlord is obliged to register the deposit for a small fee (likely to be at least €50 in any similar scheme here) and informs the tenant that their deposit is now "protected". At the end of the tenancy the landlord either returns or withholds the deposit dependent on how the tenant has treated the property and terms of the contract. If the tenant is in dispute with the landlord and does not receive satisfaction or just cause from the landlord as to the reason for withholding or not returning the deposit then there is a legal process that must be adhered to in order to settle the dispute. |
